Freedoms Advocate is providing funding for the case of Palko vs. Greater Essex Country District School Board.
In September 2024, LaSalle resident Jeremy Palko requested to appear before the Greater Essex County District School Board (GECDSB) to speak on “Faith & GECDSB” — specifically, how the board’s policies and regulations affect people of faith within the district. Despite the board’s bylaws and communication plan emphasizing openness and dialogue, his request was denied. The stated reason was that Ontario’s public education system is secular.
Mr. Palko has now filed an action with the Ontario Human Rights Tribunal, arguing he was discriminated against on the basis ofreligious creed, contrary to the Ontario Human Rights Code. Public board meetings are a service provided to the community, and the claim asserts that excluding Mr. Palko on account of his Christian faith denies equal access to that service and represents discrimination on the basis of his religious creed. The claim further notes the rights Mr. Palko has to freedom of religion and expression guaranteed under the Charter.
Mr. Palko had intended not only to raise his own concerns but also to represent a broader community of parents, students, and citizens of faith who wish to be heard by their elected trustees. The refusal left these voices excluded from the board’s decision-making process and prevented meaningful dialogue on matters that affect families across the district.
The application before the Human Rights Tribunal of Ontario seeks:
– Financial compensation for injury to dignity, feelings, and self-respect.
– An order permitting Mr. Palko to make his remarks at a future board meeting.
– A public written apology from the GECDSB.
– Clarification of public participation policies to ensure they comply with human rights law.
– Mandatory human rights training for trustees and staff.
The case has been formally filed as of September 16, 2025, and is proceeding before the Human Rights Tribunal of Ontario. Updates will be posted here as the matter progresses.
